Privacy Policy

I. Collection and consent of personal data

The personal data that we may collect through your consent either verbally, by physical and/or electronic means are as follows:

Identification data: Name, age, gender, address, phone number (home, work, cell, other), email, marital status, place and date of birth, education, professional data (occupation, level of education, positions, work email), number of children, signature, among others.

Data on physical characteristics: Physical characteristics related to your physiognomy and/or anatomy, image and voice.

Sensitive data: According to this Privacy Policy, we may collect some of the following personal data which will be treated as sensitive in terms of the law, which require special protection such as religious, moral, political, philosophical beliefs, racial or ethnic origin, health status, sexual preference, among others.

Economic and patrimonial data: Those data that reveal the socio-economic level of the participant, if you have any banking service, amount of gross income, patrimonial information, among others.

In the case of minors, the data collected will be with the prior consent of one of their parents or guardians, in order to carry out the market research study.

II. Purpose of the use of personal data

We declare that the information provided by the participant in our Market Research studies will be used for the following purposes:

To use it, store it, handle it and/or exploit it and, specifically, for research purposes of the ongoing study.

Provide the services and products required by you or any of our clients.

Inform about changes or new products or services that are related to our clients to fulfill the obligations contracted with them.

Evaluate the quality of service and conduct internal studies on consumption habits.

III. Data transfer

Based on the provisions of Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties, the responsible party may carry out transfers of personal data without the authorization of the holder.

It may transfer your personal data and be processed inside and outside the country, by third parties without a commercial or illicit purpose, but only to fulfill the provision of the contracted services and the commercial partners who directly manage and operate the information collected in the study, to detect profiles that can participate in market research studies. In no case will we market, sell, or rent personal information about you to a third party without your prior consent. If you do not express your opposition, it is understood that you have given your consent for the transmission of your data.

IV. Conservation and security of personal data

Focus Investigación will keep the personal data of the participant for the time necessary to process the market research, as well as their information requests, and to maintain accounting, financial, and auditing records in terms of the LFPDPPP and current commercial, tax, and administrative legislation.

All aggregated information and personal data obtained from you through the use of forms may be compiled and fixed to constitute an exclusive database owned by Focus Investigación; this information is stored to protect it and prevent its loss, misuse, or alteration. Notwithstanding the foregoing, Focus Investigación in no way guarantees its security, nor that it can be intercepted, altered, or stolen by third parties while traveling over the Internet.

The personal data of the Holder collected by Focus Investigación will be protected by adequate administrative, technical, and physical security measures against damage, loss, alteration, destruction, or unauthorized use, access, or treatment, in accordance with the provisions of the LFPDPPP and the administrative regulation derived therefrom.

Focus Investigación may use 'cookies' or 'web beacons' to confirm your identification when accessing our sites, with the purpose of providing you with a personalized service. By using 'cookies', we do not collect personal data from users.

V. Responsible area and ARCO rights

As the Holder of the provided data, you can exercise the rights of Access, Rectification, Cancellation, and/or Opposition to the processing of your personal data (ARCO), as well as revoke the consent you have given us for this purpose.

In order to exercise your ARCO rights, you must send your request through email: contactotij@focus.com.mx, by phone (664) 6342930 / 6342815, or directly at our offices, located at Ave. Santa María 2841 Col. América C.P. 22044 in Tijuana, Baja California.

The request must be made in terms of Article 29 of the Law, that is, it must contain at least:

(1) name and address or other means to communicate the response to your request, preferably email;

(2) documents that prove your identity or, if applicable, legal representation;

(3) clear and precise description of the personal data for which you seek to exercise any of the ARCO rights,

(4) express statement to revoke your consent to the processing of your personal data and therefore, for them not to be used;

(5) any other element that facilitates the location of personal data.

In case the request is submitted by a person other than the owner, a power of attorney issued by the owner of the personal data must be presented, signed before two witnesses, and attaching a simple copy of the official identification of you and the legal representative.

VI. Changes to the Privacy Policy

Focus Investigación reserves the right to make future modifications to this Privacy Policy, to comply with legal reforms and/or modifications to internal policies. Such modifications will be communicated by any of the means authorized by law.
